General Registration Requirements:

To register as a participant in the wholesale trade, every entity (generation/distribution licensees, direct customers, importers/exporters and small capacity electric power plants) shall file:

  • A duly filled application, addressed to the Electricity Market Operator to register as a participant of the wholesale trade of electricity;
  • An extract from the Register of Entrepreneurs about the authorized individual(s); 
  • A technical document on connection to the power grid, issued by a person to whose power grid is connected with the applicant’s power grid (for the generation/distribution licensees, small capacity power plants and direct customers);
  • A technical document, which confirms the connection of metering nodes (owned by the seeker of registration as wholesale trade participant) with “The Upper Level Computerized Electricity Metering System (CEMS)

Extra Requirements:

 For Generation and Distribution Licensees:

  • A certified copy of a license to generate/distribute power, issued by the Georgian National Energy and Water Supply Regulatory Commission.
     

For Direct Customers:

  • A certified documentation on consumption of electricity in volume as specified by the state policy during the last 12 months preceding the filing of application, and if an applicant during 12 months preceding the filing of application did not consume electricity in the established volumes by the state policy – certified documentation proving existence and ownership of electric grid commensurate with the quantitative volume as specified by the state policy at points of delivery.

For Small Capacity Power Plants:

  • A document proving a title on the real estate (power plant) (in the event of request from the Electricity Market Operator, also cadastral data) and a document proving rated capacity.

For the Trial Run of the Power Plant:

  • A written consent of Dispatch Licensee on a trial run and/or complex examination of a power plant;
  • A document certifying the ownership on real estate (power plant), cadastral data and a document proving rated capacity (only upon request of the Electricity Market Operator).

The Electricity Market Operator is entitled to request from an applicant submission of additional documents, with the aim of clarifying the above-mentioned details.

 In the event of making amendments in the above-mentioned data, an applicant shall within 5 working days submit to the Electricity Market Operator the statement of changes with the attached documentation.
 

 Terms of registration (refusal)

  • The Electricity Market Operator shall inspect the submitted documentation and accordance of actual condition with the requirements of the Electricity (Capacity) Market Rules, within the period of 10 work-days. In case of non-compliance of submitted documentation with the requirements of the Electricity (Capacity) Market Rules, the Electricity Market Operator shall inform (in writing) the applicant about the refusal (except the seeker of being registered as the importer or the exporter in the wholesale trade) to be included as a participant in the wholesale trade, indicating corresponding reason for such refusal, not later than within 10 work days after presenting the documentation.
  • In case of the individuals, who are seeking for the registration as an importer or an exporter, the Electricity Market Operator shall inspect the submitted documentation and accordance with the requirements of the Electricity (Capacity) Market Rules, within 10 work-day period. In case of non-compliance of submitted documentation with the requirements of the Electricity (Capacity) Market Rules, the Electricity Market Operator shall inform (in writing) the applicant about the refusal to be included as a participant in the wholesale trade, indicating corresponding reason for such refusal not later than within 10 work days after presenting the documentation. In the event that presented documentation meets actual conditions, the Electricity Market Operator shall include the seeker in the register of wholesale trade participants, not later than within 12 work days.
  • In case of conformity of presented documentation with the requirements of the Electricity (Capacity) Market Rules, within the following five work days, the Electricity Market Operator, the Dispatch Licensee, the applicant and the person, who owns the power network, where the applicant is connected, shall inspect the metering nodes to be used in the wholesale trade, including the generators and the metering nodes available at the self-consumption transformers and compose the inspection act as of metering nodes to be used in the wholesale trade. The Electricity Market Operator and the Dispatch Licensee shall jointly approve the form of this act. The requirements of this Clause do not apply to the registration of importers, exporters, transmission and dispatch licensees as the participants of wholesale trade.
  • In the event that inspection act of power metering nodes confirms the serviceability of these nodes, the Electricity Market Operator registers the applicant into the register within 5 working days from the date of composing the inspection act of metering nodes.
  • In the event that the inspection act of metering nodes does not confirm the serviceability of the electricity metering nodes, the Electricity Market Operator shall serve the notice (in writing) refusing to enter an applicant into the registry of wholesale trade participants, providing a relevant reason, no later than 5 working days from the date of composing the inspection act.
  • Within 24 hours from entering the entity into the registry of wholesale trade participants, the Electricity Market Operator shall notify the relevant eligible enterprise, the Dispatch Licensee, the qualified enterprise or the transmission licensee, whose power grid is connected to the power grid owned by the entity registered in the registry of wholesale trade participants.

Special Rule for Registration and Cancellation of Registration of a Power Plant Owner Person as a Wholesale Trade Participant During the Trial Run and/or Complex Examination Period of a Power Plant Aimed at its Commissioning:

The Electricity Market Operator shall checks the documentation and its compliance with the requirements of Electricity (Capacity) Market Rules within three business days. In case of non-compliance of submitted documentation with the requirements of the Electricity (Capacity) Market Rules, the Electricity Market Operator shall notify the applicant (in writing) about the refusal to be included as a participant in the wholesale trade, indicating corresponding reason for such refusal within three business days.

In the event that the submitted documents meet the requirements of the Electricity (Capacity) Market Rules, the Electricity Market Operator, the Dispatch Licensee, the applicant and the person, who owns the power grid, to which the applicant intends to be connected shall inspect the metering nodes (installed at the receipt /delivery points, where the applicant shall deliver or receive the power) to be used in the wholesale trade and compose the metering points’ inspection act, within the next 5 business days.

If the inspection act confirms the serviceability of settlement meters installed at the receipt/delivery points, the Electricity Market Operator shall register the applicant in the wholesale trading register within two business days after composing the inspection act of metering nodes.

In the event that the inspection act does not confirm the serviceability of settlement meters installed at the receipt/delivery points, the Electricity Market Operator shall inform the applicant (in writing) about the refusal to be included as a participant in the wholesale trade, indicating corresponding reason for such refusal within two business days.

Within 24 hours after the registration of the applicant in the wholesale trading registry, the Electricity Market Operator shall notify the relevant Eligible Enterprise, the Dispatch Licensee, the Eligible Enterprise or the transmission licensee that owns the power grid linked to the power grid of the applicant registered in the wholesale trade register.

Registration of the wholesale trade participant person aimed at the commissioning (trial run and/or complex examination) of the power plant shall be canceled after 90 calendar days of registration or in the event that the person registers as the generation licensee or the  small capacity power plant – Eligible Enterprise, from the date of occurrence of one of these circumstances.
